1. This policy aims to ensure barristers appear before the Industrial Court of New South Wales in attire that meets expectations
2. Robes and wigs are not to be worn when appearing before the Industrial Relations Commission of NSW or the Industrial Court of NSW, other than as set out below.
3. Wigs are not worn on any occasion.
4. Robes are not worn:
a) for ceremonial occasions;
b) before Commissioners or Judges when sitting as the Industrial Relations Commission;
c) before Judges when sitting as the Industrial Court of NSW in its civil jurisdiction;
d) before a Registrar; or
e) when appearing before a Judge in a criminal matter for mention or directions (including the Monday morning WHS List).
5. Barristers are to robe (no wigs) when appearing before the Industrial Court exercising its criminal jurisdiction for trials, sentencing hearings, interlocutory hearings, and appeals.
6. In the event of doubt, enquiry should be made of the associate to the presiding judge.
