The Commission has amended Practice Note 38 - Workplace Conduct Proceedings effective from 27 July 2026. The most significant change relates to expectations around conciliation. Parties are no longer required to come prepared to conciliate the entire claim. Instead, they are expected to come prepared to conciliate the dispute before the Commission; that is, whether the conduct the subject of the claim was or was not relevant conduct.
Several references to ‘the matter’ have also been amended to references to ‘the dispute’, in order to best reflect the limited jurisdiction of the Commission.
