At the conclusion of the hearing, the Commission Member will consider the evidence and arguments presented by the parties, all relevant legislation, regulations, rules and industrial instruments before making a decision and giving reasons.
In many cases the Commission Member will need further time to consider and draft the reasons and so will not announce the outcome on the day of the hearing. In those cases the decision is ‘reserved’, which means a decision will be delivered to the parties, in writing, later. See Timeframes for Decisions. The Commission Member may issue their decision verbally (ex tempore) on the day of the hearing, including their reasons or, in cases of urgency, they may provide reasons in writing later.
Final decisions are published and made publicly available on CaseLaw NSW.
The Commission’s decision can be appealed to the Full Bench of the Commission.
