How do I prepare for conciliation?

It is important that you prepare for the conciliation to get the best possible outcome.  

  • Read the information sent to you by the Commission, such as the Notice of Listing.  It will help you understand where to go, what to do and what to expect.  
  • Review the documents the other party will give you.  These documents will help you understand the other party’s perspective before the day.  
  • Prepare a response to the points raised in the other party’s documents. You or your representative can present these points to the member of the Commission. 
  • Create a timeline of the main events in the order they occurred (also known as a chronology).  Make a note of any evidence that supports your claims.  You can bring the chronology to conciliation and refer to these points when speaking or give it to your representative. 
  • Be flexible and realistic when negotiating a settlement because finding a solution will involve compromise. It is likely that you may not get everything you want, but preparing for conciliation will put you in a good position to resolve the matter. Think about what it will take for you to settle the matter and the conditions that you are willing to compromise. 
  • Be prepared to answer questions from the Commission member about the number of witnesses and the length of the hearing if the matter cannot settle.
  • Ensure the Commission and all parties have up-to-date contact details for you.
