Ordering a Transcript

Who can order a transcript or recording?

Parties to the proceedings to which the requested transcript or recording relates1 and their legal representatives who appear at the Industrial Relations Commission of New South Wales (Commission) can place an order through the NSW Online Registry.

Can I order a transcript or recording if I am not a party to the proceedings?

A non-party to proceedings must seek leave from the Commission under rule 2.7 of the Industrial Relations Commission Rules 2022 (NSW) if access to a transcript or information held by the Commission is needed.  The person requesting access must file an Application to Access File with the Registry. 

The application must:

  • be written; and
  • state why access is sought; and
  • state why leave should be given.

The Commission will assess whether the application demonstrates that access should be granted.  The application may be dealt with in the absence of the public and without the appearance of any person, including the applicant. The Commission may notify relevant parties about the application.

How do I order a transcript or recording?

If you have not registered with the NSW Online Registry, you can create an account to order, track, process, and receive transcripts. Once you have an account:

  1. Log into your NSW Online Registry account.
  2. Click the 'Transcripts' button under 'Browse Service' on the frontpage.
  3. Request a transcript. You will be guided through the necessary approval and billing processes. Eligible customers may apply for a fee exemption or waiver.
  4. Check the progress of your order by logging into your NSW Online Registry account.

How much does it cost?

Item 8, Part 3, Schedule 1 of the Industrial Relations (General) Regulation 2020 (NSW) provides for miscellaneous costs associated with proceedings at the Commission, including transcripts and recordings.  See Fees for more information.  

When will I receive the transcript?

If a daily transcript is ordered (and paid for, if payment is required):

  • before 10.30am and the proceedings finish sitting by 4.00pm – the anticipated timeframe for delivery is 6.00pm the same day.
  • before 1.30pm and the proceedings finish sitting by 4.00pm – the anticipated timeframe for delivery is 8.00pm the same day.
  • after 1.30pm and the proceedings finish sitting by 4.00pm – the anticipated timeframe for delivery is 10.00am the next business day.

If proceedings finish after 4.00pm, transcripts typically will not be delivered until after 10.00am the next business day.

Where a non-urgent back transcript is ordered, delivery of the transcript ranges from one to six weeks. You can specify an earlier date on the order form, but there is no guarantee the request can be fulfilled. 

Timeframes are not rigid and may vary.  Email the Reporting Services Branch (RSB) at rsb_client_services@agd.nsw.gov.au if you are concerned about any delay.

Can I copy or provide the transcript to someone?

Transcripts are subject to Crown copyright. Without the Crown's authorisation, the reproduction of transcript for any purpose other than the conduct of court proceedings is prohibited.
