An enterprise agreement is a legally binding instrument that sets terms and conditions of employment. Unlike an award, it is negotiated with, and operates in respect of, a specific employer (or employers) and is designed to accommodate enterprise-specific needs.
Once approved by the Commission, the terms of an enterprise agreement prevail over the terms of an award that deal with the same matters and apply to a person bound by the enterprise agreement.8
An enterprise agreement may be negotiated between an employer (or employers) and their employees or the industrial organisation(s) representing their employees.
