Decisions
Arbitration hearings at the Industrial Relations Commission of New South Wales (Commission) are generally open to the public. While a case in the Commission is being conciliated, the case will not be open to the public.
Published decisions of the Commission provide a record of the facts in a matter, the legal principles applied, relevant legislative provisions, and reasons for the decision made by a Member of the Commission.
Most decisions made by the Commission from 2001 onwards are published on Caselaw NSW; while judgments handed down since 1985 can be found on AustLII.
Some decisions may not be published if the Commission issues a non-disclosure order under section 164A of the Industrial Relations Act 1996 (NSW). Matters resolved by conciliation are often subject to confidentiality and are rarely published.
